TERMS AND CONDITIONS FOR TENNIS INSTRUCTION WITH A PRO


This is to confirm that I have purchased a seasonal court and have requested the following pro for teaching instruction during the Fall 2023/Winter 2024 season:

Payments for professional instruction are additional and made directly to your Pro at the time of your lesson.  Contact club for instructional fees.

Should your Pro, for any reason, not be able to continue instruction during the Fall 2023/Winter 2024 season, Rye Racquet Club reserves the right to appoint a Staff Pro to complete the season.  If, however, you do not want another Pro, a refund will be granted on a pro-rated basis only if the court is resold

It is your responsibility to notify the Club and your Pro if you will not be able to attend your lesson.

NOTE: Applications must include name, address, email address and cell number of each player in your group. Enter individual player information at the end of this form. A deposit of $500 per court hour must accompany this application. The balance is due by September 1, 2023. Late payment is subject to a fee of 2% per month. Deposits are refundable prior to June 1, 2023 on cancellation of reservation only if the club is able to resell the court for the same seasonal hours use. Deposits are not refundable after June 1, 2023. Group Captain is responsible for all seasonal court payments. Terms & Conditions:

DATES: The indoor season is 30 weeks starting Thursday, September 14, 2023 to Monday, April 22, 2024. Please note there will be no seasonal play on November 23 & 24, 2023 and from December 23, 2023 through January 1, 2024.

COURT RESERVATION: Previous year’s court reservation will be held until March 1, 2023. After that, all court reservations will be offered on a first-come, first-serve basis.

COURT DEPOSIT: A deposit of $500 per court hour ($750 for 1.5 hours, $1,000 for 2 hours) must accompany this application. No court will be reserved without a deposit. Deposits are refundable prior to June 1, 2023 on cancellation of reservation only if the club is able to resell the court for the same seasonal hours use. Deposits are not refundable after June 1, 2023. Group Captain must submit all court fees for their individual group.

PAYMENT:  Group Captains are responsible for collection and payment of all court fees. The club will not accept court fee payments from individual group players. Seasonal court fees are due in full by September 1, 2023 and any outstanding balance will be charged to the card on file.  If you prefer to pay by check/cash, payment must be received prior to September 1. If the full payment is not received by or before the first day of play,  management reserves the right to cancel this contract and retain the deposit.

GROUP PLAYERS: Group Captains are responsible for supplying names, addresses, email addresses and cell numbers of all their group players. The captain must notify their group players of the Terms & Conditions and Risk of Injury Waiver, prior to the commencement of the season or their time of play.

COURT ASSIGNMENT: The Club reserves the right to place a group on any available court and to have instruction on adjacent courts.  Assignments may be changed during the season.

PRO INSTRUCTION: Payments for professional instruction are additional and made directly to your pro at the time of your lesson.  Contact club for instructional fees.  Teaching professionals who are not RRC employees are not permitted to teach. Signed Pro Agreement form must be on file. 

If you have arranged to have a pro teach on your court for the Fall 2023/Winter 2024 season, and he/she is not available to teach at any point after your contract has been accepted, RRC reserves the right to appoint a staff pro. If, however, you do not want another pro, a refund will be granted only if the court is resold.

MAKE-UPS: We will do our best to accommodate 2 make-ups.  You must notify the club one week in advance to release your court.  If you choose not to do a make-up you may release it for resale. If it is resold, then 75% of the resale value would be credited to the captain's account.  No shows and cancellations with less than one week's notice are not eligible for make-ups.

CANCELLATIONS: Notice of closing due to inclement weather or emergencies will be emailed as well as posted on our website and on social media.

COURT TIME:  Please wait until your assigned court time begins and leave promptly at the end.  You are required to pick up all balls prior to leaving. Please dispose of any trash.

FOOD AND DRINK: Only water may be taken in a covered container.  All food and drinks are prohibited on the courts.

CELL PHONE USE: Keep your phone on silent while on court. Please refrain from long or loud calls while in the lobby or locker room areas and avoid talking about personal or confidential topics.

PERSONAL PROPERTY: The Club is not responsible for valuables lost or stolen in the club or parking lot.

TENNIS ATTIRE: Neat tennis attire and tennis sneakers ONLY. Sneakers must be non-marking and flat-soled.

RISK OF INJURY/WAIVER OF CLAIMS: The use of the facility is strictly at the player’s risk. The Club is not responsible for injuries, accidents, damages or exposures to infectious diseases you may receive from activities on the premises. All players and their guests further release the club and its employees from all suits, claims or demands for damages arising from their use of this facility. Due to insurance, the maximum number of balls per court is 6; unless accompanied by a Rye Racquet Club instructor.

TERMINATION OF AGREEMENT: The Club reserves the right to terminate this agreement. Players must follow all Terms & Conditions posted by the club. A copy of the rules is available at the front desk.

ADDITIONAL RIGHTS OF CANCELLATIONS: YOU MAY CANCEL THIS CONTRACT FOR ANY OF THE FOLLOWING REASONS: If upon a doctor’s order you cannot physically receive the services because of significant physical disability for a period in excess of six months. If you die, your estate shall be relieved of any further obligation for payment under the contract not then due and owing. If you move your residence more than 25 miles from the club. If the services cease to be offered as stated in the contract.
